According to Sources, The Delhi High Court has been given jurisdiction over the Public Interest Litigation (PIL) that the Supreme Court on Tuesday handed to it, including the appeal challenging the contentious Agnipath programme for armed forces recruitment.
In addition, the Supreme Court Justices D Y Chandrachud, Surya Kant, and A S Bopanna kept asking the “High Courts of Kerala, Punjab and Haryana, Patna, and Uttarakhand to transfer any Public Interest Litigation against the scheme that were pending before them to the Delhi High Court or to keep them pending pending the Delhi High Court’s ruling”.
The petitioners before the four high courts have the option to participate in the litigation before the Delhi High Court, according to the court.
The Supreme Court further ruled that identical procedure will be followed in any future high court petitions filed about the plan.
According to the argument, “the announcement of the Agnipath programme sparked widespread massive protests in Bihar, Uttar Pradesh, Telangana, Haryana, Uttarakhand, West Bengal, and other states”, due to the program’s four-year duration in the Indian Army and the uncertainty surrounding the future of the trained “Agniveers”.
The lawyer asked for a delay in the scheme’s implementation beginning on June 24, 2022. While ML Sharma, a lawyer, also filed a PIL to have the Center’s notification of the Agnipath programme quashed on the grounds that it was “Illegal and Unconstitutional.”
The Agnipath programme, which was unveiled on June 14, aimed to recruit young people between the ages of 17 and 21 for only four years, with the option of keeping 25% of them for an additional 15 years. Several states had seen an uprising against the plan.
A recruitment plan for Indian youngsters to join the three services of the Armed Forces had been approved by the Union Cabinet. The young people chosen for this scheme will be referred to as Agniveers. So that Agnipath enables for determined young people who are patriotic to serve in the military for four years.
