Should Blasphemy laws be enacted in India? Udaipur Murder Case

Udaipur Murder accused went to Karachi in 2014, had links with Dawat-e-Islami, shreds of evidence say Police.

The entire nation is shaken after the horrendous murder of a tailor in Udaipur. In the horrific incident, 2 men named Gos Mohammad and Riyaz were beheaded in Hindu Tailor in his shop for supporting BJP leader Nupur Sharma’s controversial remark on social media in Rajasthan Udaipur.

Not only this, assailants record the crime on camera and circulated the video on social media. One of the assailants who was identified as Riyaz attacked the tailor Kanhaiya Lal with a sharped edge while the other recorded the crime on his mobile phone. Riyaz is also associated with the Dawat-e-Islami group which is activated in Karachi Pakistan.

General Secretary of All India Muslim Personal Board (AIMPLB) Maulana Khalid Saifullah Rahmani in a press conference said ‘it is a grave crime to defame and slander any religious personality, and Blasphemy law should be enacted with all regulatory provisions.’

According to Article 44 Uniform Civil Code, all sections of society irrespective of religion shall be treated equally according to National Civil Code which will be applicable to all uniformly. Under Part IV of the Constitution of India Article 25, and Article 26 – i.e., Freedom of religion in India, and Freedom to manage religious affairs respectively. The 42nd Amendment of the Constitution 1976 defines secularism.

Indian Penal Code 1860 includes Section 295 – Injuring or Defiling place of worship with intent to insult the religion of any class, Section 295A- Deliberate and malicious acts, intended to outrage religious feeling of any class any insulting its religion or beliefs, Section 296- Disturbing religious assemblies, Section 257- Trespassing on burial places, etc.
