Madhya Pradesh Tribal Women Set on Fire Filmed As She Screamed in Pain

WHY IN NEWS ?
1. A woman belonging to a particularly vulnerable tribal group was allegedly set on fire and her agony was filmed by a group of villages in the Guna district.
2. The victim Rampyari and her husband Arjun of ‘The Saharia Tribe’ had gone to the police a few days ago saying they feared for their lives as some powerful villagers wanted their farmland, zero action was taken.
ABOUT THE WHOLE INCIDENT
In accordance to the complaint Rampyari ran to the field and tried to stop them, but they reputedly gushed diesel on her and set her ablaze.
Superintendence Police Pankaj Srivastava told a local media person that an FIR has been registered and two of the three accused are in custody.
BRIEF OF SAHARIYA TRIBE
Place
The Sahar, Sehariya our Saharia is an ethnic group in the state of Madhya Pradesh and includes few districts of Rajasthan.
Particularly Vulnerable Tribal Group
They are classified as particularly vulnerable groups.
Governing Council
The Saharia community considered every adult member part of a governing Council which is headed by a Patel.
Econom The Saharia are expert Woodsmen and forest product gatherers. They are particularly expert in creating ‘catechu’ from Khair trees. ‘Catechu’ is an extract of acacia trees used variously as a food additive and dye.
PARTICULARY VULNERABLE TRIBAL GROUP
1. PVTGs are more valuable among the tribal groups.

2. They have a declining or stagnant population, low level of literacy, pre-agriculture level of Technology, and are economically backward.
They generally inhabit remote localities having poor infrastructure and administrative support.
3. In 1973, the Dhebar Commission constituted primitive tribal groups (PTGs) as a individual category, who are undeveloped among tribal groups. In 2006, the Indian Government gave new title, the PTGs as PVTGs.
4. In this context in 1975, the Government of India initiated to identify the most vulnerable tribal groups as a separate category called PVTGs and declared 52 such groups, while in 1933 an additional 23 groups were added to the category making it a total of 75 PVTGs out of 705 Schedule Tribes.
5. Among the 75 listed PVTGs the maximal number are found in Andhra Pradesh (12) and Odisha (13)
TRIBES IN MADHYA PRADESH
Madhya Pradesh has the largest type population in the country with 46 recognize schedule Tribes, of which 3 are “particularly vulnerable tribe groups” (PVTG) spread across the 52 districts in the state.
The BHIL community comprises nearly 40% of the total tribal population followed by GOND tribes that constitute another 34% of the 1.53 crore tribal population.
Madhya Pradesh Important tribes consist of Baigas, Bhils, Bharia, Gonds, Sahariya, etc.
PROVISIONS OF TRIBE COMMUNITIES
The Indian Constitution pioneered the protection of tribal communities especially the rights to land, as the land was considered Central not only for their livelihood and development but also for their identity.
(a) In India most of the tribes are collectively identified under Article 342 (1& 2) as “Scheduled Tribe” and their right to self-determination is guaranteed by Part X- The Schedule and Tribal areas – Article 244: Administration of Scheduled Areas and Tribal Areas.
(b) The Schedule caste and Scheduled tribe (Prevention Atrocities), 1989
(c) Panchayat extension to schedule areas acts 1996.
(d) The Bharatiya committee’s (1991 ) recommendation brought this action. It safeguards the tradition and Customs of people, and their culture, identity, and traditional resources.
(e) Under the act, the Gram Sabha or Panchayat at the appropriate level shall be consulted before making:-
the acquisition of the land in the scheduled areas
– rehabilitation of the project affects people in the scheduled areas.

(f) The scheduled tribe and other traditional forest dwellers (recognition of forest rights)act, 2006.
The act passed in 2006 grants legal recognition to the rights of traditional forest-dwelling communities.

These provisions are in bulks, nevertheless, monstrously heinous crimes are existing. The reason for which laws and regulations are implemented is that purpose is not being implemented properly. We all await further proceedings move of Government and Jurisdiction.
