Gyanvapi dispute: Varanasi District Court deferred its decision, Now the court will hear on May 26

The Gyanvapi Dispute was adjourned by the Varanasi District Court. The court will now hear the case on May 26. During the hearing on Tuesday, the Muslim side requested that the case be heard between 7 and 11 a.m. Following that, Varanasi District Judge Ajay Krishna Vishwesha stated that they will now be heard on May 26th, with 7-11 being the first day. In addition, the District Court ordered both parties to file objections to the Gyanvapi Masjid survey report within seven days.

The Varanasi District Court had reserved its judgement on the Gyanvapi issue on Monday, May 23. The hearing in Varanasi’s district court lasted roughly 45 minutes. During the hearing, both the parties presented their respective arguments.

What were the arguments presented by both sides?

The Anjuman Intrageniya Committee, which governs the mosque, questioned the survey performed in Gyanvapi under the Place of Worship Act of 1991 as soon as the hearing began. The Supreme Court has requested a hearing under Rule 11 of Order 7 of the CPC, according to this side. On the other hand, it was said on behalf of the Hindu side that the commission’s survey report should be reviewed by the court first. During this session, the Hindu side requested that the CD, report, and photo of the survey be brought before the court. Simultaneously, a demand was made for the safe excavation of the supposed Shivling, as well as the measuring and gathering of all the facts.

In the context of the Places of Worship Act, 1991, Rule 11 of Order 7 of the CPC precludes any other party from making a claim against a religious location to court. In other words, a petition to change the nature and status of a holy site cannot be filed in court. That petition will not be heard under the law. The organization of any inquiry, commission, or survey to determine the nature and condition of a sacred place is not prohibited by this Act or the CPC guidelines. It will be heard if the survey report of any commission backs up the claim of the claimant side regarding the disputed religious site and the court accepts it.

Supreme Court had ordered

This conflict was the subject of a hearing in the Supreme Court on May 20. Following the hearing, the court decided that the case will now be heard in district court. Wuzu’s arrangements shall be made in the Gyanvapi Masjid, according to the court. However, the location where the disputed figure is said to have been discovered will be kept secret. The Supreme Court will have its next hearing on this matter in the first week of July.
