President Ram Nath Kovind’s term will expire on July 24, 2022, and under Article 62 of the Constitution, an election to replace the vacancy caused by the expiry of the period of office must be held before that date. The calendar for the Presidential Elections of 2022 was published by the Election Commission: The Election Commission declared on Thursday that the 16th Presidential Election will be held on July 18 to pick India’s next President.
“The ECI has fixed the schedule for the election of the office of the President of India. The notification for the election will be issued on June 15, the last date for nomination is scheduled for June 29, while the polls to be held on July 18. The counting of the votes, if needed, shall be done on July 21,” Chief Election Commissioner Rajiv Kumar stated at a press conference in New Delhi.
The legislation states that the election notice must be sent on or after the sixty-first day before the term expires. The ECI has superintendence, direction, and control over the election process to the president’s office of India under Article 324 of the Constitution, the Presidential and Vice-Presidential Elections Act, 1952, and the regulations established thereunder.
Representatives of the Electoral College, which includes elected members of both Houses of Parliament as well as elected members of the Legislative Assemblies of all States, including the National Capital Territory of Delhi and the Union Territory of Puducherry, vote for The president.
The elected members of the Rajya Sabha and Lok Sabha, as well as the Legislative Assemblies of the states, are not eligible to be included in the Electoral College and hence do not have the right to vote. Members of the Legislative Councils, likewise, are not eligible to vote in the Presidential election.
According to Article 55 (3) of the Constitution, elections are held in line with the System of Proportional Representation by way of a single transferable vote, with secret ballot voting. The elector must indicate their choices against the names of the candidates in this method.
The elector has the option of marking as many choices as there are candidates. While the first preference must be marked in order for the ballot paper to be legitimate, the following preferences are optional. When the ballot paper is handed over to the electors in the polling station, the Commission also provides them with a special pen for marking their votes.
Members of Parliament are anticipated to vote in the Parliament House polling station in New Delhi, while members of State Legislative Assemblies will vote in their respective state capitals.
Kumar indicated that the Returning Officer for the elections will be the Secretary General of the Rajya Sabha.
The election will be held using a proportional representation system with a single transferable vote. The overall number of votes cast by all MPs is 5,43,200, while the total number of votes cast by States is 5,43,231. According to the EC, the total electoral votes for the current election will be 4809.
